Terms of Service

These Terms govern your use of the learn.diya.au learning platform (the "Platform"), operated by Design Industries Pty Ltd (ABN 98 111 471 179, "we", "us", "our"). By signing in or using the Platform you agree to them.

1. Accounts

• You sign in with your Google account and are responsible for keeping it secure. Do not use an account belonging to someone else.
• Institutional programmes may attach additional terms agreed with your institution.

2. Courses, progress and the AI tutor

• Sessions unlock sequentially: progress and quiz results are computed and enforced by the server.
• The AI tutor assists learning. It will not complete quizzes or assessed work for you, and tutor interactions are logged (see the Privacy Policy).
• Gamification elements (XP, badges, streaks) are for motivation only and carry no monetary value.

3. Acceptable use

You agree not to: use the Platform unlawfully; attempt to bypass authentication, session gating, rate limits or other controls; access another person's account; scrape, disrupt or overload the Platform; or misuse the AI tutor to produce work you present as your own where that breaches academic-integrity rules that apply to you. We may suspend access for breach.

4. Content and intellectual property

Course materials, software and branding are owned by us or our licensors. Your access is a personal, non-transferable licence for your own learning; you may not republish or commercially exploit the materials. Work you submit remains yours; you grant us the licence needed to operate the Platform.

5. Availability, disclaimers and liability

The Platform is provided "as is" and "as available"; we aim for continuous operation but do not guarantee it. Course content is educational and carries no warranty of specific outcomes. To the extent permitted by law (including the Australian Consumer Law, whose guarantees are not excluded), we are not liable for indirect or consequential loss, and our aggregate liability is limited to the amount you paid us in the preceding 12 months.

6. Changes and governing law

We may update these Terms; the current version is always at this URL. These Terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction, subject to any mandatory consumer rights.
